2. About these terms
These terms govern your use of joyi-pack.com and any order or quotation between you
(“Buyer”) and JOYI (“we”, “us”). By using this site, submitting an enquiry or placing an
order you accept these terms. If you are ordering on behalf of a business, you confirm you
are authorised to bind that business.
These terms apply to both business buyers and consumers, except where a clause states
otherwise. Nothing here reduces the statutory rights of consumers in the EU or UK.
3. Two ways to buy
a) Online orders (in-stock ranges). Selected in-stock ranges, such as our
Christmas tableware collection, show public prices and can be ordered directly through the
store and paid online with PayPal. Your order is an offer to buy; the contract is formed
when we send an order confirmation or dispatch notice. If an item is out of stock or priced
incorrectly, we may cancel the order and refund it in full.
b) Bulk and bespoke orders (quotation / RFQ). All other ranges and custom
printing are handled by quotation. Quotations are valid for 30 days unless stated otherwise
and are based on the specifications, quantities and Incoterms agreed at that time. Orders
are confirmed in writing; standard payment terms are 30% deposit and 70% balance before
shipment unless agreed otherwise in a signed contract.
4. Prices, currency and duties
Prices are shown in USD unless stated otherwise, and exclude import duties, VAT and local
taxes unless expressly agreed in writing. For shipments to the EU and UK the Buyer is the
importer of record and is responsible for duties, taxes and customs clearance, except where
a delivered-duties-paid service has been agreed.
5. Payment
Online orders are paid at checkout through PayPal in USD. Bulk orders are paid by bank
transfer against proforma invoice, or as agreed in the sales contract. We do not store card
details.
6. Production, lead times and samples
Quoted lead times start from order confirmation, receipt of the deposit and approval of
any artwork or specifications, and are estimates rather than guarantees. Samples are
chargeable unless agreed otherwise.
7. Shipping and risk
We can ship on your account or arrange carriage through a nominated freight forwarder
from China. Delivery dates are estimates. Risk passes according to the agreed Incoterms;
where none are agreed, risk passes on delivery to the first carrier.
8. Inspection and claims
Please inspect goods on arrival and report any shortage, damage or defect within
7 days of delivery, with your order reference and photographs. Claims are handled
under our Refund & Return Policy.
9. Product use and compliance
Our products are intended for food-service use. We supply the food-contact and factory
audit documentation listed on our Compliance &
Documentation page for the relevant items. The Buyer is responsible for confirming that
products meet the regulatory requirements of the destination market, and for using and
storing them in line with their specification. We make no compostability or environmental
claim for a product unless that claim is supported by a certificate we hold for it and is
stated in writing.
10. Intellectual property
All site content — including text, images, product photography, logos, layout and
design — is owned by us or licensed to us, and is protected by copyright and trade mark
law. You may view, download and print pages for your own internal business use in connection
with an enquiry or order; you may not otherwise copy, republish, adapt or use our content,
images or product photography commercially without our written permission. The JOYI name and
logo may not be used without written consent.
If we print your logo, brand or artwork, you confirm that you own it or are authorised to
use it, that it does not infringe any third party’s rights, and you grant us a non-exclusive
licence to use it solely to produce your order. You will indemnify us against any claim that
artwork you supplied infringes a third party’s intellectual property. Tooling, printing
plates and moulds made for your order remain ours unless agreed otherwise in writing; we do
not reuse your artwork for other customers.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential
loss, or for loss of profit, revenue, goodwill or anticipated savings. Our total aggregate
liability for any order, whether in contract, tort or otherwise, is limited to the value of
that order.
We do not exclude or limit liability for death or personal injury caused by negligence,
fraud, or anything else that cannot lawfully be excluded. Nothing in these terms affects the
statutory rights of consumers in the EU or UK.
12. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control,
including raw material shortage, energy restriction, epidemic, port congestion, carrier
failure, customs action or government measures.
13. Privacy
How we handle personal data is set out in our Privacy Policy
and Cookie Policy.
14. Governing law and disputes
These terms are governed by the laws of the People’s Republic of China. The parties will
try to resolve any dispute amicably; failing that, it will be submitted to arbitration in
Hangzhou, China, conducted in English, and the award is final and binding.
15. Changes
We may update these terms; the version published on this page applies to new orders.
